A quick summary of current New Jersey expungement law

WHAT is an expungement?

    An expungement is a court procedure that allows citizens previously convicted of a crime to expunge their record. In other words, it allows a person to CLEAR THEIR RECORD of prior convictions and arrests.

WHY should someone get an expungement?

    If someone is applying for a job, applying for new home, joining any association or organization that may conduct a background check, and simply anyone that wants their record clear will find an enormous benefit in getting an expungement to clear their record.

WHO may get their record expunged (cleared)?

    Anyone who has been convicted of a crime, disorderly persons offense, petty disorderly offense, or a municipal ordinance violation may need an expungement. Crimes, disorderly persons offenses, and municipal violations are treated differently, and some are excluded from expungements altogether. Our questionnaire helps people determine, generally, if their record may be cleared. For legal advise, however, a person should consult an attorney to find out if their particular circumstance may qualify for an expungement.
